Claims Continue to Mount Against DePuy for Defective Hip Replacement Products
As more information becomes available about the alleged side effects suffered by recipients of DePuy hip replacement products, there has been a corresponding rise in lawsuits aimed at the company. Citing numerous potentially life-threatening health concerns, litigants have recently begun to flood the Texas legal system looking for answers.
Last month, DePuy struck a multibillion-dollar settlement agreement with recipients of its ASR Hip System implant. In addition to the settlement, the company issued a voluntary recall of the ASR Hip System, reaching out to patients with offers of full reimbursement for medical expenses associated with the recall, including deductible expenses, copays, travel costs and lost wages. And now, before the dust has even had time to settle, DePuy is facing another round of lawsuits.
In Texas courts, 5,239 lawsuits are currently pending in regards to DePuy’s Pinnacle hip implant. These plaintiffs claim that the Pinnacle implant has a propensity for sudden device failure and can even lead to severe metal poisoning in patients, which is similar to the ASR implant cases.
The number of plaintiffs is expected to grow as information about the lawsuit spreads to more recipients of the device. In addition, the Pinnacle hip implant is still available on the market, which could give rise to many more forthcoming claims against the company in the future. As of yet, a recall has not been issued.
This series of lawsuits does not bode well for DePuy, which manufactures a wide range of hip replacement devices. If the health risks associated with the ASR device can be established as common among the company’s range of devices, it could cost DePuy and its parent company, Johnson & Johnson, billions more in settlements.
